Onkyo Sued By NY/NJ Sales Rep. Firm Of 20 Years

Roth Paris Associates, a prominent manufacturers rep. firm serving the consumer electronics industry has filed a lawsuit against Onkyo - a manufacturer of consumer electronics audio and video products - seeking damages for wrongful termination and breach of contract. Roth Paris had been representing Onkyo in the New York, New Jersey territory for twenty years. Early in 1999, the company was terminated by Onkyo's newly appointed Vice President of Sales and Marketing, Mark Friedman. In turn, Mark Friedman assigned the sales representative contract to New York Marketing - a company owned by Mr. Friedman. Allegations by the plaintiff, Roth Paris, state that Mr. Friedman's dual role as Onkyo Senior Vice President of Sales and Marketing and owner of New York Marketing, amounts to interference with contract and unfair competition. In addition to the above, Roth Paris is alleging that Onkyo's decision to terminate their company was done in bad faith. Roth Paris contends that for several years, Onkyo failed to properly market and support their products claiming budgetary considerations. Roth Paris also contends that when Onkyo once again decided to actively begin marketing their products, Roth Paris was terminated and denied the opportunity to recoup their losses and capitalize on their longstanding loyalty with the company and its retailers. The case of Roth Paris versus Onkyo has been ongoing for two years. During a recent court appearance Onkyo made a motion to dismiss these allegations. They were denied by the court.
